1.        Scope of Services & Pricing

Spazzio Enterprise LLC dba Spazzio Lux provides personal shopping and sourcing services. By engaging our services, you (the "Client") authorize Spazzio Lux to act as your agent in locating and purchasing items based on your specifications.

·        Pricing Model: We do not charge an upfront or separate "Sourcing Fee." Instead, once an item is successfully located and vetted, we provide the Client with an "All-In Procurement Price." This price includes the cost of the item, our procurement markup, and any applicable overhead.

·        Merchant of Record: Client acknowledges that Spazzio Lux acts as the merchant of record for all transactions. The All-In Procurement Price is a unitary price for a delivered product; it is not a "cost-plus" arrangement. Spazzio Lux is under no obligation to disclose the original wholesale or retail purchase price of the item.

·        Client Autonomy: Client acknowledges that they are under no obligation to use Spazzio Lux’s services and are free to search for, source, or purchase the desired items through other retailers or marketplaces at any time prior to accepting our quote. * Price Finality: By paying the quoted All-In Procurement Price, the Client agrees to the purchase and acknowledges that the markup represents the value of our expertise, time, and sourcing capabilities. Once payment is made, the price is fixed and is not subject to negotiation, adjustment, or "price matching" based on prices found elsewhere.

 

2.        Approval & Condition Report

For all items, especially high-value luxury or refurbished goods, Spazzio Lux will provide the Client with a "Digital Condition Report" consisting of high-resolution photos and/or video.

·        Mandatory Approval: The Client must provide written approval (via email or text) of the item’s condition as shown in the report before we complete the purchase.

·        Acceptance of Condition: Client’s approval of the Digital Condition Report constitutes an acknowledgment that they are satisfied with the item’s cosmetic and functional condition as disclosed.

·        Final Sale: Once the Client approves the item and payment is processed, the sale is FINAL. No returns or refunds will be issued for "change of mind" or for cosmetic issues that were visible in the Digital Condition Report.

 

3.        Condition of Goods (New vs. Refurbished)

In accordance with the law, we clearly distinguish between product conditions:

·        New Items: Defined as unused, in original manufacturer packaging.

·        Refurbished/Reconditioned: These items have been previously owned but professionally restored. They may show minor signs of wear. Spazzio Lux discloses all known defects or cosmetic issues prior to purchase.

·        Hybrid Restoration (Donor Parts): For certain refurbished items, specifically luxury bags, restoration may require the use of materials or components from a secondary "donor" bag of the same model and brand to ensure structural and aesthetic integrity. By purchasing a refurbished item, the Client understands and accepts that the item may consist of authentic components sourced from multiple original units. Such items remain authentic to the brand but are categorized as "Restored/Hybrid."

·        Disclosure: Under Florida Statute § 817.413, it is unlawful to misrepresent used goods as new. We provide written confirmation of the item's condition at the time of sourcing and request your acknowledgment via digital signature or written approval.

 

4. Refund and Return Policy

FLORIDA STATUTE § 501.142 NOTICE: PLEASE NOTE: Spazzio Enterprise LLC dba Spazzio Lux DOES NOT OFFER CASH REFUNDS, CREDIT REFUNDS, OR EXCHANGES ON SOURCED ITEMS.

·        Finality of Sale: All sales are final once the Client has approved the Digital Condition Report and payment is processed. Because items are sourced specifically for the Client, we cannot offer returns for "change of mind" or buyer's remorse.

·        The "Goodwill" Exception (Last Resort): Notwithstanding the above, Spazzio Lux prides itself on client satisfaction. If a significant issue arises that was not captured in the Digital Condition Report, we may, at our sole and absolute discretion, work with the Client to source a replacement item. A)This is intended as a last resort only; B) The Client acknowledges that because they confirmed the item’s condition via video/photo prior to shipping, any replacement is a gesture of goodwill and not a legal obligation.

·        Shipping Costs: In the event that a replacement is authorized, the Client is responsible for all shipping, insurance and handling costs associated with returning the original item and delivering the replacement.

 

4a. Mandatory Condition of Return for Replacement

In the event Spazzio Lux authorizes a replacement as a last resort, the following conditions must be met. Failure to comply with any of these requirements will result in the immediate forfeiture of the replacement option. Spazzio Lux utilizes high-resolution internal photography for all high-value items. Any item returned for replacement that does not match the unique identifiers recorded by Spazzio Lux prior to shipping will be rejected and reported as a potential fraudulent claim.

·        Original Condition: The item must be returned in the exact condition in which it was received. For refurbished items, this includes the absence of any new cosmetic wear, scratches, or internal tampering.

·        Security Tags & Seals: Any security tags, "void if removed" stickers, or identification bands attached by Spazzio Lux must be intact and untampered with. If a tag is cut or reattached, the return will be rejected.

·        Complete Packaging: All original packaging, dust bags, authenticity cards, certificates, manuals, and accessories must be included. For luxury items, the loss of a single "extra" (like a clochette or care booklet) significantly diminishes value and will disqualify the item for replacement.

·        Inspection Period: The Client must notify us of any intent to request a replacement within 24 hours of delivery. The item must be postmarked for return within 3 business days of the replacement authorization.

·        Usage: The item must be "unused" since delivery.

 

5.        Shipping & Risk of Loss

·        Shipment Contract: All sales are "Shipment Contracts." This means the risk of loss and title to the goods pass to the Client at the moment Spazzio Lux delivers the item to the carrier (USPS, FedEx, or UPS).

·        Shipping Method: For the Client’s protection, Spazzio Lux ships all high-value items via Priority Mail (or an equivalent expedited service) with a Mandatory Signature Requirement upon delivery.

·        Insurance: Spazzio Lux will purchase additional shipping insurance covering the full All-In Procurement Price of the item. In the event of loss or damage during transit, Spazzio Lux will provide the Client with the necessary documentation to facilitate an insurance claim with the carrier.

·        Carrier Limitations: Spazzio Lux is not responsible for: A) Carrier delays or logistical errors; B) Damage caused by the carrier during transit; C) Theft after delivery: Once the carrier records a successful delivery (evidenced by the required signature), Spazzio Lux’s responsibility is fully discharged. We are not liable for "porch piracy" or theft occurring after the item has been signed for at the delivery address.

 

6. Refurbished Items and Disclaimers

·        Refurbished Items: Refurbished items are sold "AS IS" and "WITH ALL FAULTS".

·        Disclaimer: TO THE EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

 

7. Payment and Taxes

·        Sales Tax: All purchases are subject to Florida’s 6% sales tax plus any applicable county discretionary surtax based on the delivery address. Florida Sales Tax is calculated based on the All-In Procurement Price. Client is responsible for all applicable taxes and discretionary surtaxes based on the delivery destination within Florida.

·        Invoicing: Total costs include the item price, our service fee, shipping, and taxes. Payment is required in full before the item is dispatched.

 

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE FLORIDA LAW, SPAZZIO ENTERPRISE LLC AND ITS EMPLOYEES SHALL NOT BE LIABLE TO THE CLIENT FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. THIS INCLUDES, BUT IS NOT LIMITED TO, LOSS OF PROFITS, LOSS OF USE, OR DIMINUTION IN VALUE OF LUXURY OR ELECTRONIC GOODS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THIS AGREEMENT, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, SHALL NOT EXCEED THE TOTAL AMOUNT OF THE SERVICE/SOURCING FEE PAID BY THE CLIENT TO SPAZZIO ENTERPRISE LLC FOR THE SPECIFIC ITEM GIVING RISE TO THE CLAIM. CLIENT ACKNOWLEDGES THAT THE SOURCING FEES REFLECT THIS ALLOCATION OF RISK.

 

9. Governing Law, Venue & Dispute Resolution

These terms are governed by the laws of the State of Florida.

·        Mediation: Before filing any legal action, both parties agree to attempt to resolve the dispute through formal mediation in Martin County, Florida.

·        Venue: Any legal disputes shall be settled exclusively in the courts located in Martin County, Florida.

 

10. Trademark & Brand Disclaimer

Spazzio Lux is a trade name of Spazzio Enterprise LLC. We are not affiliated, associated, authorized, endorsed by, or in any way officially connected with any of the brands or manufacturers advertised or featured on this platform. All product names, logos, and brands are the property of their respective owners. The use of these names and brands does not imply any cooperation or endorsement.

 

11. Acknowledgment or Value & Choice

By proceeding with a purchase, the Client confirms they have had ample opportunity to conduct their own market research and have voluntarily chosen to utilize Spazzio Lux’s sourcing services at the agreed-upon price. The Client agrees that they will not contest the purchase price or the markup applied after the transaction has been initiated, nor will they use price discrepancies found after the fact as a basis for a refund or a credit card chargeback.
